The animal rights group said the court rejected the prosecutor’s argument that animals are to be categorically excluded from a “necessity defense.”

Judge Gaskell also struck these causes of action for Perdue executive Scott Fitzpatrick. Perdue is now removed from the case and only two causes of action remain for Fitzpatrick.
